TCPA Compliance Policy

1. What is the TCPA?

The Telephone Consumer Protection Act (TCPA) is a federal law that restricts telephone solicitations and the use of automated telephone equipment. It covers calls and text messages to mobile phones, automated voice calls, and faxes.

2. Our TCPA Compliance Commitment

• Obtain prior express written consent before making autodialed or pre-recorded calls or texts
• Honor all Do-Not-Call (DNC) requests within 10 business days
• Maintain an internal Do-Not-Call list and scrub against the National DNC Registry
• Provide clear identification of the calling party in all communications
• Restrict calling hours to 8 AM – 9 PM in the consumer's local time zone
• Include opt-out mechanisms in all SMS communications

3. Consent Requirements

3.1 Prior Express Written Consent

For marketing calls and texts using an automatic telephone dialing system (ATDS) or pre-recorded voice, we require:

• A clear and conspicuous disclosure that the consumer will receive autodialed or pre-recorded calls/texts
• The consumer's affirmative agreement (not a condition of purchase)
• Identification of the party whose calls/texts the consumer is consenting to receive

3.2 Consent Documentation

All consent records are maintained with timestamps, IP addresses, and the exact consent language presented to the consumer.

4. Advertiser Requirements

• Confirm that all consumer data provided includes valid TCPA consent
• Provide documentation of consent language and collection methodology
• Agree to our TCPA compliance addendum as part of the advertiser agreement
• Indemnify Taka Deals for any TCPA violations stemming from their non-compliant practices

5. Do-Not-Call Policy

Taka Deals maintains an internal Do-Not-Call registry and scrubs all call lists against the National DNC Registry, state-specific DNC lists, and our internal DNC database.

6. Violations and Remediation

Any TCPA complaints are investigated within 5 business days. Confirmed violations result in immediate suspension of the non-compliant campaign and, where appropriate, termination of the advertising relationship.
