These Terms of Use ("Terms") constitute a legally binding agreement between you and Taka Deals. By accessing our website, submitting an advertiser application, or using any of our marketing services, you agree to comply with and be bound by these Terms.

2. Services Description

Taka Deals provides performance marketing services including but not limited to:

• Cost Per Sale (CPS) and Cost Per Lead (CPL) campaign management
• Pay Per Call traffic generation
• Multi-channel digital advertising (Facebook, Google, TikTok, DSP, Content)
• Lead generation and consumer acquisition services

3. Advertiser Obligations

• Provide accurate and complete information about their offers
• Ensure their offers comply with all applicable laws and regulations
• Honor all approved commission rates and payment terms
• Not engage in fraudulent activities or misrepresent their products/services
• Maintain proper consumer disclosures on their offer landing pages
• Comply with FTC, TCPA, and other applicable regulatory requirements

4. Prohibited Activities

• Generating fraudulent leads, clicks, or sales
• Promoting illegal products or services
• Targeting minors (under 18) without appropriate safeguards
• Making false, misleading, or deceptive claims in marketing materials
• Violating TCPA regulations or sending unsolicited communications
• Attempting to reverse engineer or circumvent our tracking systems

5. Intellectual Property

All content, trademarks, logos, and intellectual property on the Taka Deals platform are owned by or licensed to Taka Deals. You may not reproduce, distribute, or create derivative works without our express written consent.

6. Payment Terms

Payment terms for CPS and CPL campaigns are defined in individual advertiser agreements. Taka Deals reserves the right to withhold or reverse payments for fraudulent, invalid, or non-compliant leads or sales.

7. Limitation of Liability

To the maximum extent permitted by law, Taka Deals shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount paid by you in the 30 days preceding the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless Taka Deals and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your violation of these Terms, applicable laws, or third-party rights.

9. Termination

We reserve the right to suspend or terminate your access to our services at any time, with or without cause, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

10. Governing Law

These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Lucknow, Uttar Pradesh, India.
